1. About Us
CreandoWeb is an AI-powered web design and development service, operated from Colombia with international reach. For questions about this policy, contact us at hola@creandoweb.co or WhatsApp +57 313 478 0694.
2. Services We Provide
We build professional websites using Artificial Intelligence supervised by engineers. Our services include landing pages, corporate websites, portfolios, blogs, online stores, and custom web applications. Each project is unique and developed according to the requirements agreed upon with the client.
3. Payment Terms & Conditions
- Two-stage payment: an upfront deposit is collected at project start (percentage agreed upon per plan), and the remaining balance is due only after the client approves the final design. Full payment is never required until the result meets what was agreed.
- Design approval: the client has the right to review the result and request adjustments before making the final payment. The project is not considered closed and full access is not granted until explicit client approval is received.
- Payment methods: we accept bank transfers, digital payment platforms (PayPal, Wise, or others agreed upon), and other methods arranged at project start.
- Refunds: if the project does not proceed due to reasons attributable to CreandoWeb, the deposit will be refunded. If the client cancels after work has begun, the deposit is non-refundable as it covers the time and resources already invested.
- Currency: prices are expressed in US dollars (USD) unless otherwise agreed. Payments in local currency are converted at the exchange rate on the day of the transaction.
4. Revision & Change Policy
- Before approval: unlimited revision rounds are included at no extra cost. Our goal is to deliver a result the client genuinely approves.
- After launch: post-launch changes are subject to the contracted plan. Basic plans include a minor adjustment period (text, images, or color corrections). Structural modifications, new sections, or additional functionality are quoted separately.
- Scope changes: any modification that exceeds the originally agreed scope (new pages, integrations, platform changes) will be evaluated and quoted before execution.
- Response time: minor changes are handled within 2 to 5 business days depending on workload. Urgent projects can be prioritized by prior agreement.
5. Hosting & Domain
- Annual renewal required: both web hosting and domain names (.com, .co, .net, etc.) are services provided by third-party infrastructure providers that require annual renewal. This cost is separate from the website development cost and is the client's responsibility to keep current.
- Domain ownership: we recommend clients register their domain in their own name from the start. CreandoWeb can assist in the process, but ownership should remain with the client to ensure independence.
- Non-renewal: if hosting or domain expire due to non-payment to the provider, the site may become inaccessible or the domain may be released and acquired by third parties. CreandoWeb is not responsible for interruptions resulting from failure to renew.
- Managed hosting: on plans where CreandoWeb manages hosting, we will notify the client in advance of the renewal date and cost. The client expressly authorizes renewal upon purchasing the plan.
6. Intellectual Property
- Client ownership: upon full payment, the client owns the rights to the design and code developed specifically for their project.
- Third-party content: stock images, icons, fonts, and other third-party elements are subject to their own licenses. CreandoWeb will only use resources with licenses compatible with commercial use.
- Portfolio: CreandoWeb reserves the right to include the project in its portfolio and marketing materials, unless the client requests confidentiality in writing.
- AI tools: content generated with AI tools is reviewed and adapted by our team. Responsibility for the use and licensing of the final content is shared between CreandoWeb and the client.
7. Personal Data & Privacy
- Data we collect: name, email, WhatsApp number, business information, and files voluntarily uploaded to the request wizard.
- Purpose: data is used exclusively to provide the contracted service, communicate with the client, and improve our internal processes.
- No data sharing: we do not sell, transfer, or share personal data with third parties without explicit consent, except as required by law.
- Your rights: you may request access to, correction of, or deletion of your personal data by emailing hola@creandoweb.co.
- Retention: we retain data while the client has an active relationship with CreandoWeb, and for up to 5 years afterward for legal compliance purposes.
8. International Compliance
- GDPR (European Union): if you are an EU resident, you have additional rights: data portability, the right to erasure, and the right to lodge a complaint with your local supervisory authority. Legal basis for processing: contract performance and consent.
- CCPA (California, USA): if you are a California resident, you may request information about the personal data we hold, request its deletion, and opt out of the sale of your data (which we do not perform).
- Colombian law: this service is governed by Colombian Law 1581 of 2012 on Personal Data Protection. We apply the same standards internationally.
- International transfers: data may be processed on servers outside Colombia (e.g., cloud services in the US or Europe). We take reasonable measures to ensure an adequate level of protection.
9. Cookies & Tracking
- Essential cookies: we use technical cookies necessary for site functionality (language preference, admin panel session).
- Analytics: we may integrate services such as Google Analytics to analyze traffic anonymously. You can disable these from your browser settings.
- We do not use behavioral advertising cookies or track users across third-party sites.
10. Limitation of Liability & Warranties
- SEO & rankings: CreandoWeb guarantees that sites are built following good technical SEO practices (structure, speed, metadata). However, search engine rankings depend on external factors (Google algorithms, competition, content quality) beyond our control.
- Service availability: we do not guarantee uninterrupted availability, as it partially depends on third parties (hosting, DNS providers, etc.).
- Business results: the commercial success of the website depends on multiple factors beyond CreandoWeb's control (market conditions, client strategy, advertising). We do not guarantee specific sales or conversion results.
- Force majeure: CreandoWeb will not be liable for failures caused by events beyond its reasonable control (internet outages, natural disasters, pandemics, etc.).
11. Policy Updates
CreandoWeb reserves the right to update these policies at any time. Changes will be published on this page with the update date. For significant changes affecting ongoing projects, we will notify the client by email or WhatsApp at least 15 days in advance. Continued use of the service implies acceptance of the current policies.
12. Governing Law & Jurisdiction
These policies are governed by the laws of the Republic of Colombia. For any dispute, the parties agree to first attempt an amicable resolution. If no agreement is reached, the dispute will be submitted to the competent courts of Colombia. For clients in the European Union, applicable local legislation will be respected as appropriate.
